Federal prosecutors said they are looking for a 14-year prison term for the disbarred California legal officer Tom Girardi after being accused of embezzling several millions of dollars from the customers and being convicted for wire fraud in August.
As much as the prosecution admitted that Girardi is 85 and has some cognitive impairment, in a sentencing memo filed on Friday in the federal court of Los Angeles, the prosecution said that Girardi should get a significant custodial sentence in a federal prison.
“His embezzlement of the client’s funds from his law firm for several years and the numerous falsehoods he uttered about the stolen money are malicious and treacherous acts of betrayal of the people who sought him out when they were in desperate situations,” the prosecutors stated.
”Girardi would likely die in prison, the defendants in these circumstances who are now his federal public defenders insisted in their Friday sentencing memo.
Instead, they said he should spend the rest of his days in a medical prison for men who were criminals before they got dementia and some form of Alzheimer’s.
They said that was the information that would place Girardi among the most qualified candidates for medical release in the entire nation.
The US attorney’s office located in the central district of California has refused to speak to the matter.
Lawyers for Girardi did not respond to queries about the matter at first.
After they claimed that he embezzled $15 million in settlement payments meant for downtown clients, Girardi was found guilty of four counts of wire fraud by a jury.
A sentencing was scheduled Dec. 20 in Girardi’s case. The sentence could determine whether federal prosecutors in Chicago decide to dismiss their criminal charges against Girardi who is alleged to have mis appropriated more than $3 million belonging to the victims of the October, 2018 Boeing 737 MAX Lion Air Flight 610 crash in Indonesia.
Girardi was once a prominent member of the United States plaintiffs bar. Erin Brockovich worked on a pollution case against a California utility that formed the theme of the movie with the same title and an Oscar award.
He is the ex-husband of Erika Jayne Girardi, a star in the “Real Housewives of Beverly Hills.”
Cohen’s fans have insisted for Years that he has dementia even when a federal judge determined that he was sufficient enough to be put to trial.
They said this to US District Judge Josephine Staton, Your honor, a federal facility cannot deal with someone with Girardi’s condition, they stated that he is not a threat to society, and that he was not likely to rear offense.
